Truth and consequences

As you all know by now, Deb Frisch — in addition to being reviled by nearly everyone she has come into contact with — is also delusional. To wit, for the last year, she’s been trying to rewrite the history of our encounter, citing — as the key piece of “evidence” in her ongoing threats to sue me, my attorney, Brit Hume, her lawyers, Michelle Malkin, the Denver Police, various judges, the screen actor’s guild, the City of Tulsa, Jesus, et al. — the fact that I told Arizona Star reporter Kim Smith that I didn’t feel threatened after our first encounter.

Frisch, using what she fancies her considerable powers of erudition, always comes to the same conclusion (today’s version of which follows; no link, of course — let her gin up her own traffic):

Under offensives, [the police report notes] “Threats.” on or between 7-3-06 at 0800 hours and 7-30-06 at 0800 hours.

But the plaintiff’s allegation is easily shown to be false by reading this July 10, 2006 article in the Arizona Daily Star by Kim Smith who interviewed the plaintiff and wrote “Goldstein said he never felt threatened by Frisch.”

I guess Detective Mullins (Denver PD 98045) missed that day in kindergarden when they learned reading. And I guess [her first lawye] (Colorado #24513) missed that episode of Perry Mason where you learn to “collect all relevant evidence.”

I wonder if filing false testimony to an officer of the law is illegal in Colorado the way it’s illegal in Oregon?

Again, I’ve remained silent about all this, letting Frisch convince herself over time that her version of events has some merit, and that she has ensnared me — confound her genius! — with her Dupinesque skills as a detective.

But it’s time she heard differently. Which is why I I’m posting this here, now, so that the record can be put straight.

First, the police report she alludes to was filed after Frisch’s second round of strafing (where she posted as my son, my wife, etc), which took place much later in July, while my family was off at a baseball game. That same night, she posted vulgar comments purportedly from members of my family on Patterico’s site and Ace’s site. And it was at that point — after determining for certain that she was behind those posts — that I decided to take the threats seriously enough to file a police report (for the express purpose of getting a temporary restraining order).

Frisch keeps clinging to this single news article as if it were a legal life raft. But the plain truth is, she’s clinging to a rationalization that is every bit as doomed as her career. If Frisch ever does follow through on her (now) innumerable threats to sue the world and its various villains, I hope she subpoenas the reporter, Ms Smith — whose notes will show that, while I might not have thought Frisch a bodily threat after her initial attacks on my family, my wife certainly did. And, of course, whether I did or not is irrelevant, because, as I told every reporter I talked to, where a child is involved, you err on the side of caution. And I took the threat to my child seriously.

I also told them that I didn’t plan to waste my fifteen minutes of fame on a disgraced former adjunct professor.

For some reason, Frisch seems to think that what a reporter chooses to print from an interview is dispositive. But as with so much else, she is wrong. And a lot less clever than she believes herself to be.

It’s unclear who, other than herself (and maybe a few search engines), Frisch is trying to convince with her legal play acting. Still, she repeats these things over and over, trying, I suppose, to train her own memory to accept her own twisted chronology as truth.

But here it is, spelled out in black and white: I filed the police report after the second set of attacks on my family — and everything subsequent to my filing of that report proves to me that I made the absolute right decision.

So you see, my legal concerns with Frisch have never centered around her first round of posts — but rather around the second round, which in turn convinced me to report that first round to the authorities. For her part, my wife had already decided to report Frisch to the FBI.

Perhaps one day Ms Frisch will get the help she needs. More likely, though, she’ll wind up living amid a maze of newspaper stacks with a hundred or so cats, chasing the neighborhood kids off with a broom because they make fun of how she ambles around the yard in those big fuzzy pink slippers, muttering to herself about “shysters” and “sexual harassment.”

So. There you have that. Put paid to it, and ante up for the next hand.

    Best of luck with all this, Jeff. I’ve managed to cut truly unhinged people out of my life, but I realize now I’ve been lucky not to encounter any as single-mindedly self-destructive as she. It’s unbelievable, really. I hope everything works out for you.

    Glad to see that you haven’t “gone” anywhere…I truly enjoy your site and have read it almost daily for several years…until the last few months when I thought you had left to deal with the insane Deb. I have the unfortunate experience of dealing with a person like Deb….they usually don’t get over it..they need serious medication which they usually don’t take. But, reading your current post remind me of the tinfoil hatted leftist loons out there and it explains a lot about them. Thanks for the site Jeff and good luck!!

    I recall, back in the early days of this nonsense when her original site was till up, a post in which she referred to her parents giving her grief about her being a nutcase with a vengeance.

    So yeah, they’ve been ineffective or they’ve simply given up.

    Gavin Debecker, I believe, would recommend against engaging DF on any level at this point, and monitoring her activities for signs of escalation of danger to you and yours.

    What I’ve come to understand, however, is that no matter what *you* do, the internet will supply her virtually infinite audience – and there will always be some misquided someone somewhere, ill or well meaning, who will write about her or to her in response to her rants and ramblings. This will feed her conduct no matter what you do, so you might as well take all necessary means to get her engaged in the system, inadequate as it is in dealing with persons like her.

    Her mental illness puts her in a higher risk category of comitting harms. She won’t behave as a reasonable person would act or even act in her own best interest, and she could take a turn for the worse at any time.

    She doesn’t understand or pretends not to comprehend that your original threat assessment would be subject to revision in real time if she gave you more reason to worry. You had and have the right to revise your assessment of the threat level presented by her ORIGINAL trolling. FWIW, experts have also patiently and kindly explained to her the clean hands doctrine.

    You might not have much, but you seem to have a little anxiety about her suing or damaging your reputation in some way. Her words and actions have been so awful, and irrational, that If she tried to hire a lawyer based on any of her threats to sue, they would back away slowly, turn and run for their lawyer lives.

    She has the potential to become vengeful. She has suicidal and homidal fantasies and makes rather blatent and sometimes rather veiled allusions to them. Right now she has up a post about the music she wants played at her funeral. While it is posted in the “innocent” form of a common blog poll, it is troubling in light of her instability and shared “jox” about blowing herself up and taking enemies, innocents, or government landmarks, with her.

    No one can diagnose her over the internet, of course, but she isn’t “just” a drunk. What you need is someone to assess the real risk and come up with a plan for managing it. FWIW, I’ll chip in.

    I don’t think her family has washed their hands of her but I given the limitations and aggravations of dealing with the mentally ill, they may be in some denial or at a loss as to what to do to help her. They may have troubles of their own….

    Even a successful green warrant will put her away for a matter of ….days. Voluntary commitment as a sentencing condition for a minor crime would also likely be short. It’s almost as if one has to hope she will commit a serious crime so that she could be locked up in the criminal justice system.

    If I have any positive advice, it’s that you must accept you have to look over your shoulder now, for your sake and your family’s.

    Her response was, frankly, cuckoo:

    Well, sure, if I actually press (or persuade the Denver DA, I guess) charges against you for the misdemeanor of lying to a police officer, you would try to defend yourself. If you tried to discredit your testimony to Kim Smith, I’d have two responses.

    1. While you bitched to the Tucson Citizen about their coverage of the incident, you didn’t bitch about the AZ Star coverage, suggesting you thought Ms. Smith’s paraphrase was accurate.

    2. The plaintiff in the Denver RO case is you, not your wife. The plaintiffs in the El Paso lottery game (trying to extort $1 million from me) are you and your wife. If she was so afraid, why wasn’t she on the RO and why didn’t she join the party until December, when there was money involved?

    I’m waiting for her to persuade the DA’s office to file charges against me. I mean, it’s not like she doesn’t have the time to convince them to do so. Hector and demand and threaten — all while assuming the mantle of victim. It’s what she is.

    I’m not sure how much is known of this, but Frisch called the homes of partners of my attorney’s law firm — as well as those in other states associated with the firm in some ways.

    She told members of the firm that my attorney solicited anal sex. This is who she is. This is what she does.

    She has nothing but time. And she plans to fritter away that time not with, say, charitable works, but by trying to bring everyone else down to her level.

    It’s sickening.

    I wish I could explain to her that telling a reporter “you never felt threatened” by her first troll through your blog, no matter what came afterward, doesn’t mean claiming later that those were threatening remarks, later on, is a lie.
    I predict she will now make a frustrating argument that you can never assert the frist remarks were threats, even if her second ones threatened you, as if your feelings about them has been “locked in” from that day forward, and immutable under any circumstances. (Even, say after being challenged by your peers, your wife, the police, health experts – , or on your own time after reflecting on the remarks or finding out disturbing information about her.) in this case, she followed up with enough weirdness to change your mind about what degree of threat DF posed in general, but also how threatening the original remarks were. (The hyper-literalism she exhibits is suggestive of an information processing disorder.)

    The urge to set her straight is pretty understandable, but also pretty futile. Lest she attempt to defeat any restraining order in effect, or to defend against the imposition of a restraining order, I think you should probably check the urge to contact her in any way except through your lawyer or the courts. Or not.

    The talk about her parents reminds me, IIRC, they were apparently mollified when she told them her remarks on your blog had been maliciously altered. I wonder if they actually bought that story.

    Jeff, this isn’t as far fetched as it might seem. I had a similar experience with a neighbor of my elderly Mother. She had begun to latch on to my Mother and saw herself as THE most important person in her life. I am an only child and I was living in your old stomping grounds [redacted], Maryland at the time. When I drove into California for a month long visit with my Mother, this neighbor went into jealousy overdrive and began a campaign against me that ended up costing me my physical health. It started with a gossip campaign with the neighbors and members of my Mother’s swim club that I was visiting with an eye on causing my Mother physical harm because I wanted her money (a ridiculous charge on its face since I was my Mother’s only heir and she didn’t have much money anyway). She spread rumors that I suffered from bipolar disease and refused to take my medication. A lie on both counts. She then began the rumors that I physically prevented my Mother from eating in attempt to starve her to death. This was especially preposterous since we were going out for dinner almost every night I was there. She then took it one step further and called the police one night when we were out very late having dinner with my Mother’s brother and my cousins. She told the police that I had left to return home and that since I’d departed in the early morning, no one had seen my Mother nor was she answering the phone and that she was convinced that I had killed her and then left to return to Maryland. I had not left and my Mother and I were out together all day and all evening. The police acting on this neighbor’s concerns broke into my Mother’s house in the wee hours of the morning and ended up manhandling me to the point that my back was broken. It took six years to fight this fight and I ultimately won a substantial cash settlement from the county authorities, although my Mother did not live to see the victory. She passed at the age of 94, two years before we got the case to court. We had to move her away, selling the home my Mother had lived in for 29 years, I had to move to California to help my Mother protect herself from this crazy woman and it is a nightmare that still has an effect on me in the form of post traumatic stress syndrome. We got a restraining order, but even that was useless because every time this woman started her sh!t, she was the “little old lady” and I was the big bad daughter.

    Unlike Frisch, who everyone by now knows is crazy, this little old lady neighbor garnered much sympathy because she was a “little old lady” and no one believed, at first, she was evil and that included me. When you live your life relatively normally, it is hard to see those around you as evil or out to do you harm, it isn’t in our nature about people who live and play where we do. I was blind to much of this woman’s machinations against me and even after it became clear that she was behind the rumor mill, I still looked at her as the grandmotherly neighbor and wouldn’t let myself believe she would want to harm me or hurt my Mother by trying to separate her from her only child. Even after we moved my Mother over a hundred miles away from her old neighbor, the woman kept up her harassment with a barrage of greeting cards all with the warning, “be careful” or “I worry about your safety,” etc. My Mother became so frightened that just seeing her handwriting on an envelop brought on panic attacks so severe, my Mother had to be hospitalized and on one ambulance trip she even stopped breathing and had to be put on a respirator. The most frustrating thing was when an authority type said to me, “well if your story is the true one, then why didn’t you report the woman to adult protective services?” Like I was somehow remiss for not taking this step. Since my world, and my Mother’s world did not include getting into some APS system or any system, I never even thought about such a step until it was discovered that she was attempting to have my Mother declared incompetent and have herself named the Conservator over my Mother’s finances. She claimed in her brief to the Committee that my Mother had no living relatives. By the time I became aware of this action, she had already convinced several people that her claims were true. The last thing my Mother was was incompetent, especially about finances and a letter from her stock broker was what convinced the Committee that this “little old lady” was nuts. They weren’t taking my word for it, not even my word that I was in fact the daughter with valid Powers of Attorney that had been executed nearly 10 years earlier and that my name was on all my Mother’s bank and stock accounts as co-owner and that I had never ever exercised my position in that role for good or bad because my Mother was more than capable of taking care of her own business.

    The lesson I learned is be the squeaky wheel and make sure you are the first to act. If you are always in defense mode, it is far harder to defend yourself and prove the lies are lies. And never assume someone is sane or incapable of evil acts no matter how normal they might act or no matter how “grandmotherly” they might seem. Frisch is evil. She is a danger to anyone who gets into her sights. She is now adept at manipulating the system, probably far more adept than any of us or you who are not used to dealing with the system on a regular basis. Stay on offense! And God bless you and your family and keep you safe.

Notice how she accused you of wanting your mother’s money when in fact she was the one who wanted it. Kinda like how the French accused us of going to Iraq for oil when in fact they refused to go into Iraq because of oil. But I digress…

    Jeff, pay attention to the accusations she makes against you and the motives that she attributes to you. They’re her very own, projected, and they could provide a clue into what she wants or intends to do.

    Exactly why this is so troubling. She is very consistent in using sexually explicit images (usually involving children) in her “writing”.

    Since making a public stand against her, my daughter has been a central character in her deranged fantasies. I am anonymous, which is a blessing that Jeff does not have. All the more reason to admire Jeff’s resolve.

    And it is totally NUTS – I think I agree with an earlier poster and not directly engage her. Also, it sounds like to me that her family (in what form – ex?-lover with the children, parents and siblings)and definitely previous colleagues have rejected her and when this happens she slides a little deeper into this psychotic obsession of threats and stalking you and yours. It keeps her preoccupied from dealing with and able to deny almost everyone that matters wants nothing to do with her. This situation lets her feel in control of her loser mess of a life – perhaps an effort to even prove to the people who rejected her she is right.

    And she thrives on any attention you give her. Craves it, I am thinking.

    Re: reports. Frisch called the police and asked about the report I filed, and they responded by asking Frisch if she meant the Jeff Goldstein who lived at _______. Luckily, she didn’t have a pen, which I know because when she posted about it she only got a bit of the address right.

    Turns out that the police report is public record, and had she not advertised that she was ordering a copy, she would have gotten it unredacted. As it is, I was paying attention and called the records people, sent them along the RO, and had them redact the information. So when she received the report, nothing of value remained.

    The defense attorneys haven’t shared anything with Frisch, to my knowledge. Instead, she spends her time calling court clerks, etc., law firms, police records divisions, etc, trying to get information.

And because Frisch’s threats were not explicit (other than the extortion threats and the libel), he just wasn’t interested. We have been told to go the civil route, which as you know takes a lot longer and provides no remedy for getting Frisch to stop in the interim.

    Incidentally, she talks about the money we demanded (pretty standard, as I understand it) — but during our preliminary injunction hearing we told the judge we weren’t interested in money, and that we had offered several times to settle with no monetary demands.

    Unfortunately, Frisch — acting as her own counsel — has responded by demanding we pay her. Because, you see, she’s not very well.

    I can personally vouch that you never take chances with deranged women. Last year I became romantically involved with a woman who I quickly determined was just using me to avoid working or spending any of her own money. By quickly, I mean that when I sold my second guitar I was sure of it. It took two weeks to get her to move out of my house, and she stole my car when she left. In retrospect I should be glad that is all that she stole from me. When the police arrested her and recovered my car, they told me she was claiming to be my wife. I told them that it was not true, and stated “I don’t want to have anything to do with or say a single word to that bitch. I just want my car back.” A cursory check showed she had multiple warrants and was using a false identity. They never contacted me to testify against her, so I’m assuming she figured a way to get out of any jail time, but who knows? The good thing is I only have received one phone call from her since (it’s been a year), but I get harrassing phone calls from credit card companies that she gave my phone number and address to as her own.

    Anyway, the point is, you should always be on your guard about the motives of people. Assume the worst about someone until they prove worthy of your trust. It is really, the only real way to behave. It doesn’t mean you can’t be civil, just guarded.

    And yeah, the scary thing about my case is I knew this woman for over 2 years before things began to get out of hand. In retrospect I suspect drug abuse, but I never witnessed it firsthand. It’s just a gut feeling.

    Evidently, she should be able to post about me and my family at will — clogging up search engines with libel as the law does nothing to stop her, and as the courts are impotent in preventing her — and if I respond, I am just as guilty as she the “havoc” I have caused.

    Frisch has repeatedly — hundreds of times, in fact — violated the restraining order; she has repeatedly flouted the preliminary injunction order; and the other day, when she began posting the personal information of my friends, I decided to break my silence and answer her spurious “charges” rather than sit back and take it any longer.

    If this is part of some “ploy” — do you honestly think Frisch and I are in this together, Scott? — I’m not sure what that “ploy” is.

    But this is precisely the kind of “bend over and take it or you are no better than she” nonsense that makes people look at the criminal-coddling law and its moralist defenders as sadists.

    Sorry, but I’ve sat by and watched as this woman has fed my son’s name and libels about me to search engines unchallenged for a year. If my speaking the truth to her allegations is “havoc,” then so be it.

    And I don’t fear for my life, necessarily; I am concerned for my child and my wife, of course, and concerned that Frisch is actively libeling us and hoping to cause my son and me reputational harm — but my commenting has no bearing on any of that. She has done the same whether I’ve commented or not.
