I have gotten email upon threatening email to rescind what I said last year about the Duke Women’s Lacrosse Team and their uninformed support for the accused rapists in the Duke rape case. The case that was mishandled, manipulated and finally dropped on Wednesday.
I usually ignore emails that intend to *put me in my place* but I think we owe it to our supportive readers to say something outside of “black strippers are lying whores” and the “we won” mentality that seems to have overtaken the public imagination with the dreaded interplay of rape and race.
I just want to say first and foremost, I still stand by what I say and have said. It does look bad for people to support accused rapists, at that point we didn’t know the facts either way. Furthermore, women of color are in fact OFTEN sexually assaulted and usually the criminal justice system and/or the media either overlook it or mishandle it. Women of color often have a higher burden of proof that they are not lying about rape. Case in point (as Amanda and others stated ): when the lack of DNA evidence was announced—before we even knew whether the players were innocent or not—people were quite quick to accuse the accuser of being guilty of lying. So be it.
The charges were dropped. Does this mean that they are innocent? None of us actually know what happened that night. Sorry, unless you were there, you don’t know what happened. Now for the rest of you that have such a die hard belief in the criminal justice system and evidence, well quite frankly I pity you. This is a system that arrests a disproportionate number of people of color, subjecting them to unfair trials, inadequate representation and longer sentences (in a prison system that resembles slavery) SORRY, I don’t trust the courts. When you’re a woman of color who’s a sexworker, up against white kids with money that can afford *good* lawyers, the outcome is not looking so good.
They were not found to be innocent, the charges were dropped from lack of evidence. Moreover, innocent until proven guilty only applies to certain people. Ideally, it would apply to everyone but *a lot* of people are guilty at arrest, just for being who they are and where they are. We are not operating in a vacuum, but within a long history of corruption and injustice in the supposed justice system. So, if these guys were in fact falsely accused, they got a taste of how black men are treated EVERY DAY by the criminal justice system.
And what is the outcome of all of this? The general public now believes that black strippers ARE in fact lying whores and the worst thing that could happen to a strapping Duke lacrosse player is that his lily white reputation is marred by false accusations. Beyond this being a terrible precedent set for women that bring up rape accusations (still something underreported) to never ever report rape again, the racist and sexist reaction from the media and public have been to say the least profound.

Well, Samhita’s right about one thing: we certainly can’t shame her anymore than she already shames herself here.
Let’s take a quick look at the assiduous condescension and moral superiority on display in this ludicrous defense of sweeping generalization, sociological stereotyping, and doctrinaire establishment feminist identity politics.
First, note how Samhita is quick to label the Duke Women’s Lacrosse team “uninformed” at the time of their initial defense—marking their support of the Men’s Lacrosse Team kneejerk, reactionary, and anti-feminist. Yet it is a safe bet, given their commonalities, that those women knew the members of the men’s lacrosse team better than Samhita, or the Faculty 88, etc.—which would make the female lax team’s support far less illogical and kneejerk, in lieu of all the facts coming to light, than the condemnation from those who knew even less about the players or the party.
Samhita then tries to rally the troops and garner some ideological sympathy by appealling to “our supportive readers”—that is, people predisposed to believe, like Samhita, that the Women’s Duke Lax team are sisterhood sellouts—in order to form the skeleton of her defense. This is quickly juxtaposed with caricaturish depictions of those who early on found so much wrong with the accuser’s story that they began to question the rush, on the part of the DA, the university administration, and sociological “theorists” of all stripes, to convict the indicted players: those who remained dubious and eventually came to support the Duke 3 are not concerned about justice, the argument goes, so much as they are either in proving that women of color are lying whores, or else waxing triumphal over the laying bare of dangerous academic cant—which in this instance was used to galvanize the “intellectual” equivalent of a torch-bearing mob intent on lynching a type for a host of historical transgressions they came to represent.
Sadly, the individualism of the Duke 3 never mattered to these culture warriors. All that mattered is how they could be used to further their particular grievance narratives—from feminism to post-colonialism to anti-capitalism to institutionalized racism. And in fact, Samhita here marshals as many of these as she can to shield herself from the criticism she so very richly deserves. Setting aside rationalizations (nearly all of them of the tu quoque variety: innocent until proven guilty only applies to certain people, blacks go through this kind of thing every day, etc.—making one wonder why, if this is such a problem, she would be willing to perpetuate the very kinds of offenses she claims to abhor), she writes, for instance, of a “public imagination” “overtaken” “with the dreaded interplay of rape and race”—neglecting to mention that the interplay of rape and race was in fact foisted on the public as part of the narrative being constructed by people like Samhita in order to secure the conjoinment, a double-grievance against which to set “white male privilege.”
She goes on to complain that the “general public now believes that black strippers ARE in fact lying whores” (a strawwoman-of-color argument if ever there was one), before bemoaning the “terrible precedent set for women that bring up rape accusations (still something underreported) to never ever report rape again.” But what she doesn’t do is acknowledge that the responsibility for what she imagines will be increased public suspicion rests equally with the lies of this particular accuser, and with the kneejerk support given her at the expense of the accused by people who have spent their lives stoking grievances in order to institutionalize identity politics, which they then parlay into political power.
How ironic it is, then, to watch Samhita use the fact “none of us actually know what happened that night” as a defense not only for preemptively assuming guilt, but for ignoring the evidence since presented that caused the charges to be dropped.
Because, pace Samhita, the charges weren’t simply dropped as a matter of passive voice. They were actively dropped after a fresh investigation pointed to the shabby, politically motivated prosecution by Nifong—one that was emboldened and offered succor by the politics and sociological fetishes of people like Samhita.
You will not be shamed?
Too bad. Because until you are, you will never learn what it means to be the kind of American envisioned by the rich white males who put together the Constitution, a Constitution under whose protections you seek to dehumanize individuals in the service of a collectivist ideology.

Excuse me, but that is not what the head attorney or the lead prosecutor (whatever he is, he’s the last word) said!! He said they were innocent! It’s because, again as mentioned in the press conference, she contradicted her own stories time and time again. The one witness we knew about also recanted. Those are just a couple examples of the numerous holes in this case.
Yes, rapes and assaults happen, a lot. I don’t know about the actual stats on whether these crimes are committed diproportinately against women of color, or that no one will believe them. But for “feminists” and race-baiters to focus on this case, and support Mangum no matter what, does not help real rape victims and it does not atone for the crimes that go unprosecuted. When’s the last time you heard of Jesse Jackson offering an actual rape victim a free ride to college? When’s the last time he or Sharpton wept for the exploitation of scantily-clad dancers in rap videos?

By all accounts the accuser has mental/emotional problems. I think it would be a mistake to focus the anger on her. Not surprisingly, it is common for people who are not tracking reality very well to make false charges.
When the system is working properly, the police and prosecutor filter out charges that cannot be substantiated. In this case that didn’t happen, because people like Samhita hijacked the accuser to use as a stalking horse for their own political agendas.
It wasn’t just that people like Samhita were emboldening Nifong. If it wasn’t for people like Samhita, Nifong would have tried to get elected by prosecuting crimes, rather than committing them. The only reason he went after the Lacrosse players was to curry favor with the black community and elite white liberals.

I’m afraid that even a “not guilty” verdict wouldn’t get you off the hook in the eyes of people like Samhita. An acquital only means that there’s a reasonable doubt about guilt. It’s not a finding of actual innocence. Samhita and her ilk would probably hold up that distinction to claim that “no one knows what happened,” or that the accused still did it.
It would probably take multiple eyewitnesses and video/electrnoic evidence to get someone off the hook in her eyes. Even then, you better hope you’ve lived a spotless life and have the right political views, because if you haven’t she’ll hold up your transgresssions to proclaim you an evil misogonist who just got a taste of the injustice that women and brown people (*shudder*) experience every day.

If the Duke Women’s Lacross Team really wanted to support these brave and wonderful young men, they would have provided a Live Sex show for the party. Why were these lads forced to spend 800 of their parents hard earned dollars hiring two lazy strippers, who refused to do a live sex show or strip because the lads didn’t behave.
