We haven’t really moved the needle back much. In fact, too many people have thrown in with the inevitability of this rank movement, including many on the “right.”

    Off-topic, but I’m curious, Jeff, about your thoughts regarding the faithless elector ruling against Colorado and its possible effect on the “National” Popular Vote Interstate Compact.

    The linked piece cites Frank McNulty of Protect Colorado’s Vote:

    Tuesday’s ruling could undermine the law by prohibiting the state from requiring electors to vote for the popular vote winner, said Frank McNulty, an adviser to Protect Colorado’s Vote, which wants voters to overturn the law. But the ruling could also free electors to decide on their own to support the candidate with the most votes nationally, he said.

    “It is a double-edge decision,” he said.

    I’m not sure about this. I think if, say, in 2020, the Compact were in effect, and the majority of the “national” popular vote went to Trump, the Compact would require that Colorado send its Republican electors’ votes to be counted in Washington, D.C. on January 6, 2021 even if the Democrat ticket received 100% of the vote in Colorado.

    In that event, the electors allowed to vote wouldn’t have to be “required” to vote for the popular vote winner — they’d be champing at the bit. It’s whoever decides which slate of electors gets to cast their votes for Colorado, perhaps the Secretary of State, that would be subject to the Compact.

    So, if anyone’s hoping the ruling will overturn Colorado’s participation in NPVIC, I’m afraid they’ll be disappointed. I think it won’t have any direct effect at all.
