Oh, I don’t know. So long as reasonable people agree that your speech is offensive…

…what’s the rationale for defending the antiquated need to tolerate HATE when what you could be doing is protecting the civil rights of those under attack by the haters?

— Who for the most part are non-Muslim white Christians.  And conservatives, whose latent domestic terror proclivities hang threateningly over a compassionate nation dedicated to social justice and multiculturalism.

The First Amendment isn’t absolute, after all, and if you push for consensus interpretation in other instances — or as a rule– there’s really no reason you should be allowed to treat preferred amendments as sacrosanct monuments to dead white slave holders.

Which, textualist bonus!

    Dear Fed,

Exactly what “Civil right” have I violated if I post the Mohammed cartoons?

Be specific, footnote appropriate SCOTUS decisions.

I’m just certain that the Feds will come down equally hard on every Facebooker who makes a comment about Catholic priests and altar boys.

Thank you, Oliver Wendell Holmes (and co-tyrants) for the assault word ban

Justice Department to Hold Seminar Warning Against the Legal ‘Consequences’ of Anti-Muslim Speech

That should be a short seminar, not even time for tea and biscuits.

  9. My thinking too, SW. If sent a cease-and-desist letter for expressing an opinion, the correct reply would be, “No.”

If a follow-up is sent, it should be returned with a cease-and-desist letter of my own, outlining my position that their position — that I don’t have the right to insult someone — is an opinion, on an equal footing with my opinion that lawyers who try to silence speech because it offended somebody, ought to be horsewhipped as public entertainment.

  10. BigBangHunter says:

    – Yeh well, you just wait. The Muslims will take only so much of this intolerant demand to obey silly laws in the UK before they slice off a few heads, and then those racist blokes will be sorry.

  11. Should I go Kickstarter with my idea for a 24-hour cable channel on which lawyers are to be horsewhipped?

  12. leigh says:

Well, excepting the lawyers we like. I say go for it.

  13. It is hard to find good entertainment these days.

  16. palaeomerus says:

I hear from a friend of mine who is a law professor that if you shout “Fire in a crowded theatre” your right to free speech is not protected and you can be prosecuted for it. I suspect that If you whisper it they can get you obstruction of justice too because you tried to cover it up that you shouted it by shouting it quietly. If you do it three times in front of a mirror then Bloody Mary will appear and issue you a summons. But she may look tired because it’s a long way from Scotland, 426 years ago, to here. Jet lag. Y’know.

  22. palaeomerus says:

I think falsely yelling that “we got trouble right here in River City” should be illegal too. And singing “Shipoopi” in some half assed Buddy Hackett voice should earn one the death penalty.

  24. Bloody Mary was Good Queen Bess’ sister, a Tudor queen of England — not to be confused with Bess’ cousin, the Stuart queen of Scots.

    Another piece on this.

The Department of Justice did not respond Friday to a question about what guidelines it draws concerning offensive speech and Islam, or whether the department believes that civil rights statutes could be used to stifle criticism of Islam.
    […]
“He’s just wrong,” said Floyd Abrams, one of the country’s most respected First Amendment attorneys. “The government may, indeed, play a useful and entirely constitutional role in urging people not to engage in speech that amounts to religious discrimination. But it may not, under the First Amendment, prevent or punish speech even if it may be viewed as hostile to a religion.”

“And what it most clearly may not do is to stifle political or social debate, however rambunctious or offensive some may think it is,” Abrams said.

I think the Obama administration has a completely different view on the 1st just as it does of the 2nd any every other amendment. They speak a language all their own which resembles English but is not.

You seem to have the evidence on your side, cranky.

  27. I’ve decided to throw down on this DOJ seminar.

  28. Silver Whistle says:

The area’s top federal prosecutor, Bill Killian, will address a topic that most Americans are likely unfamiliar with, even those well versed on the Constitution; that federal civil rights laws can actually be violated by those who post inflammatory documents aimed at Muslims on social media.

Bill, you’re going to have to show your work if you expect us to buy that one.

Some of the finest people I’ve met are Muslims,” Killian said, adding later: “We want to inform everybody about what the law is, but more importantly, we want to provide what the law means to Muslims, Hindus and every other religion in the country.[..]

    OK, I’m convinced.

Honky? Who says that? I haven’t heard anyone called honky since the old Blaxsplotation movies (Cleopatra Jones, etc.) from the 70s. The only people I ever hear saying “nigger” are blacks.

  36. David Block says:

Yes, there’s a lot of “wetback” in Texas. It has decreased a lot from the 1970s, though. Didn’t know a bunch of old folks used Twitter.
