Gabby Gifford’s husband, Mark Kelly, buys two semi-auto firearms [Darleen Click]

… when his hypocrisy is discovered he rushes to put up a Facebook post worthy of Emily Litella.

Mark E. Kelly, gun-control proponent and husband to former Congresswoman Gabby Giffords, recently purchased an AR-15 (an “assault weapon,” he called it)—which he now says he intended as an illustration of the need for more stringent gun laws.

Kelly reportedly bought the AR-15 and a 1911-style semi-automatic pistol at a gun store in Tucson, Arizona.

Breitbart News received a tip on this when Neil McCabe, editor of Guns & Patriots newsletter, contacted us on March 7 and said:

Mark E. Kelly, made purchases which included an AR-15–sometimes described as an “assault rifle”–at 3:30 pm on the afternoon of March 5 at Diamondback Police Supply, 170 S. Kolb Street, Tucson, AZ.

According to McCabe, witnesses to the purchases claimed Kelly purchased “high capacity” magazines as well.

On March 6, McCabe contacted Kelly’s gun control group–“Americans for Responsible Solutions”–and on March 8 they replied that his message had been passed on to colleagues who handle press requests. Breitbart News then began investigating the details surrounding the purchase, including visiting the gun store.

Suddenly, Kelly announced on his Facebook page that he was not going to keep the AR-15, which he has yet to pick up from the store.

Days after making the purchases, Kelly wrote on Facebook:

I just had a background check a few days ago when I went to my local gun store to buy a .45. As I was leaving, I noticed a used AR-15. Bought that too. Even to buy an assault weapon, the background check only takes a matter of minutes. I don’t have possession of it yet but I’ll be turning it over to the Tucson PD when I do.

Isn’t it amazing that an astronaut would pass a background check with flying colors? Wow! And he’s only going to get rid of the AR-15, while the .45 semi he bought is as much as “assault” weapon as the AR-15?

Kelly, you’ve been discovered as a fraud. Go home and take care of your wife and let people make their own choices of how they will protect their families.

    That just reads weird as all get out, unless he somehow should believe himself to be deranged or otherwise unfit to purchase a weapon. Which, of course he doesn’t, does he?

    The Gifford-Kelly duo makes me long for the days when people knew it was time to withdraw from public life. That people can delude themselves that they are working for some greater good while infringing on the rights of others and knowing full well their own hypocrisy makes me long for the days when they would roll out Mr. Brady to dribble all over himself.

    An AR-15 is not a class III weapon it is the semi-auto version.

    The thing that is weird is that he didn’t just take the AR-15 home then. If he passed the background check for the 1911 then the run of another check for the AR-15 would have gone through too.

    Last time I was at a gun store there was a real nice used semi-auto rifle for sale. It wasn’t an AR, but I don’t see why you would say it never happens.

    Just a background check and that can go through quickly, in minutes, or you can be on “delay” for up to 5 business days if the check has problems. Even someone who has been on delay, once cleared, will for about a week or so be cleared almost instantly for another gun.

    To be clear. AR’s are not Class III.

    I don’t know the protocol for Class III weapons purchase but since you have to have gone through an FBI background check to get a Class III license I can’t see that there would be a waiting period there either. Just a transfer tax payment.

    If you have a class 3 wouldn’t that suffice for a background check, is all I am asking.

    You can get a weapons permit in GA that eliminates the waiting period and speeds up the whole process a great deal, I would think a class 3 would also.

    I’m positive he had a Class III clearance, BMoe. The guy is an astronaut and has been fine-combed by the FBI.

    Of course, I haven’t actually seen it, so I’ll wait for Lee to kick sand in my eyes.

    It is a common misconception that an individual must have a “Class 3 License” in order to own NFA firearms. An FFL is required as a prerequisite to become a Special Occupation Taxpayer (SOT): Class 1 importer, Class 2 manufacturer-dealer or Class 3 dealer in NFA firearms, not an individual owner. Legal possession of an NFA firearm by an individual requires transfer of registration within the NFA registry. An individual owner does not need to be an NFA dealer to buy Title II firearms. The sale and purchase of NFA firearms is, however, taxed and regulated…

    Let me stress this again. An AR-15 is not a full auto weapon, it is not an NFA registry weapon, it is simply a semi-auto rifle.

    Arizona may, for all I know of them, require a waiting period before you can pick up a firearm that you purchased. I would be surprised if they did however.

    Absent a State waiting period, and since he had cleared the normal form 4473 submitted background check, there is no reason that he could not have taken possession that day.

    You’re right, Geoff, that an AR-15 isn’t an automatic weapon. My mention of the Class III classification was in passing a background check for any weapon. I wasn’t being specific to the purchase of an AR-15.

    If you have an FFL and are Class 3 then you as a business can buy without background checks for your business. I doubt that Mr. Kelly has a business that buys and sells firearms much less NFA registry firearms.

    IIRC even if you do have a business doing so you must do the background checks if you are purchasing for your own private ownership.

    A psychological evaluation is in order. Since AR15s are weapons of war, clearly Kelly is suffering from some PTSD from his time in NASA.After all, if we can’t trust our vets to be armed, former astronauts have no earthly business owning an assault weapon.

    Why would you buy an AR-15 from a police supply gunseller just to turn it over to them? He got caught buying firearms and made up a story, I think.

    And when you find them, they’re twice what they normally go for. I’d love to know just what Commander Kelly spent on his straw purchase for the Tuscon PD.

    It’s only a straw purchase if the PD reimburses him for it. Otherwise it’s a gift which is ok.
