ACLU: Supermax Prison Too Harsh for Battlefield Detainees [Dan Collins]

Just as we predicted, it constitutes another form of torture. John Stephenson’s got the story at STACLU.

Meanwhile, Cuba would like very much to have Guantanamo back, now that Jimmy Carter’s back in office.

  1. Guantanamo is embarrassing to El Jefe because it’s so much nicer than the Gulag Next Door.

Arnold Schwarzenegger, Jerry Brown will ask U.S. to end oversight of California prisons
Officials say receivership has become a government unto itself. Overseer says such action would prolong unnecessary deaths and suffering among inmates.

Reporting from Sacramento — Gov. Arnold Schwarzenegger and Atty. Gen. Jerry Brown will ask a federal judge today to end court oversight of healthcare in California prisons and return the inmate medical system to the state’s control.

In a filing with U.S. District Judge Thelton E. Henderson, who seized prison healthcare from the state nearly three years ago, Brown and Schwarzenegger administration officials are expected to contend that the receivership has exceeded its authority and violated federal law with an $8-billion plan to renovate healthcare clinics and build seven “holistic” facilities for 10,000 inmates.

“We believe the receivership has become a government unto itself, operating without accountability, without public scrutiny and without clear standards,” Brown said Tuesday. “Tremendous sums have been spent, and tremendous progress has been made, but we feel that it’s time to place the responsibility on the director of corrections and not have this parallel government operating on its own.”

I’ve think we should make GB US Territory and then open the border to all comers. That’d be hilarious, watching Cuba build their own Berlin Wall.

Because people are so enamored with their tropical Communist paradise.

  4. Joe says:

Maybe it is cruel and unusual because the SuperMax facility is in Florence. Cuba is just so much nicer.

  5. Joe says:

I was being sarcastic above. Florence is very nice. I do not want my “intentionalism” to be misunderstood.

But if Murtha has his way and he gets a pork butt new SuperMax facility in his district then the ACLU may have a point, Western Pennsylvania may be cruel and unusual punishment even for al Qaeda scum.

  6. Bob Reed says:

moving Gitmo detainees — including many only suspected of crimes — to the country’s most secure prison “is simply another form of torture, one which makes a mockery of ‘innocent until proven guilty’…”

Is this lady on crack, or what..? What are we supposed to do, rent them a room at the Ritz, with room servoce, until their “trial” date..? Do they get massages too? With “happy endings”..?

    Puhleez!

You know what? Supermax is too good for them. I say we just put them in general population at the prisons that house the most hardened criminals in the US. Not only would it be better treatment then they’d recieve in their home countries, the inmates would pull a “Dahmer” on them inside of a couple of months; problem solved, everybody’s happy…

I’m getting tired of this lame argument anyway. For starters, these folks are enemy combatants, not in any uniform, who asttacked or were planning to attack US forces or friendly tartgets; essentially the same as covert operatives-like spies. The Geneva convention that is so often referred to during this argument does not technically apply to these individuals!

Second, only in some rainbow colored unicorn world will this have any effect on how US soldiers will be treated if captured by the Islamo-fascists. Do you think that because Habib is not sleep deprived, that a US soldier will not be beaten horribly when taken? Do you think that becasuse Kamal didn’t essentially have to play naked twister with Jamal, “H-H-He arranged us so Kamal’s balls were in my face!”, that the friggin’ Jihadist pigs won’t ultimately decapitate any prisoners taken and post it on Arab youtube for all their buddies to see..?

Does the one! think that simply because he believes in his own absolute moral authority that the Islamo-Nazi’s will simply tell him whatever he asks, or release any of our troops being held..?

This is simply to throw a bone to the nutroots and try to get kudos from the Europeans…

Hell, they are essentially in dhimmitude already!

Obama maintains that Booooooooosh! strengthened AQ by his well known, thanks to the lefty MSM trying to score political points, tough detention and interrogation measures. And, he thinks that this move will be the cause of peace breaking out between us and the Islamo-Nazis, and all over the Muslim world. But, he will only embolden those cockroaches, especially if they know that the worst that will happen if captured is 3 hots-and-a-cot, a lazyboy recliner, and conjugal visits from the “virgins” at the bunny ranch; instead of a small taste of what they dish out to their captives…

Now that’s hope that Al-Queda can believe in!

  7. router says:

Just shoot them on the battle field per the Geneva Conventions.

  8. AKA Pablo says:

    Alactraz. I like it.

  9. router says:

Also shoot Canada geese and eat them.

  10. Dan Collins says:

It’s no good trying to throw those back, router.

  11. Spies, Brigands, and Pirates says:

I’ve think we should make GB US Territory and then open the border to all comers.

I read “GB” as Great Britain at first.

I think they’ve already done that, actually.

  12. Stephanie says:

Actually, the designation of the inmates at Gitmo is in limbo right now because MaObama rescinded the Exec Order that specified they were enemy combatants… so now there is a question as to what they are entitled to under the Geneva Conventions. Any bets on which way MaObama will go?

If they are redesignated as POWs they are not allowed to be interrogated…

  13. AKA Pablo says:

If they are redesignated as POWs they are not allowed to be interrogated…

…or tried. And you have to let them go when the war’s over. What remains to be seen is whether we give them green cards.

  14. Joe says:

Canada Geese are only good to eat if you wrap them with bacon.

    Which reminds me…

If you feed that to these detainees they will convert to Christianity and be harmless in no time.

  15. Darleen says:

What really alarms me is that Camp Pendleton is on a list of possible places The One is considering to “house” the jihadists … Let’s just make northern San Diego a huge target for al Qaeda buddies to slip across the border from lawless Mexico.

Not one of these illegal combatants should ever set foot on US soil, let alone at a military base!

  16. Joe says:

How about Berkley? That might be a good place for al Qaeda to go.

  17. George Orwell says:

Just what does not constitute a form of torture any longer? Is there any way we can make it up to these poor benighted souls in Gitmo?

I’ve lost nearly five seconds of sleep over their tragic, unjust situation.

  18. McGehee says:

Just what does not constitute a form of torture any longer?

I can only think of two things: paying taxes, and watching Chris Matthews get the screaming thigh-sweats for President Jesus.
