“Justice Needs More Time”
I’ve already detailed how the ever-malleable Commerce Clause, after Raich, could hurt constitutional challenges to ObamaCare — though I suspect this time around Scalia would be less enthusiastic about its expansion, and so would walk back prior reasoning.
