“Marine’s Charges Dropped in Iraq Deaths,” AP:

A general dropped all charges Thursday against a Marine who had been accused of killing three Iraqi brothers in response to a roadside bomb attack in Haditha in 2005.

“The evidence does not support a referral to a court-martial,” Lt. Gen. James Mattis wrote in his written decision.

Lance Cpl. Justin L. Sharratt, 22, had been charged with the murder in the deaths of three of those killed after the bomb attack Nov. 19, 2005.

The decision to drop the charges followed an earlier recommendation from a hearing officer who listened to evidence in the case. Under military law, a commanding general has total jurisdiction over a case.

In his recommendation, Lt. Col. Paul Ware said murder charges brought against Sharratt were based on unreliable witness accounts, poor forensic evidence and questionable legal theories.

“The government version is unsupported by independent evidence,” Ware wrote in an 18-page report. “To believe the government version of facts is to disregard clear and convincing evidence to the contrary.”

Personally, I think they should have gassed him.

Because you have to admit, even if it didn’t happen the way the government charged it had, it certainly could have.

And sometimes you have to sacrifice the factual on the altar of the plausible if you hope to draw any real and inspiring significance from a narrative.

As it stands now, the story’s ending — well, it’s just so unsatsisfying, you know?

I mean, where’s the lesson? How am I to feel?

    Our out-of-control army full of poor uneducated soulless killbots (whom we support and love dearly, lest you question our patriotism) gets away with MURDER! while their commanding officers look the other way.

    What’s funny is that I’ve sensed my crunchy granola friends are suffering from OUTRAGE! fatigue even more than the rest of us are suffering from Iraq fatigue and Presidential campaign fatigue. Turns out that it’s hard to stay that wound up for years on end.

    It is amzing how fast this whole situation ran with the Marine being villanized before any real trial or review of the case. Makes Dan Rather proud….

    On December 21, 2006, the U.S. military charged eight Marines in connection with the incident[5]. Four of the marines, Frank Wuterich, Sanick de la Cruz, Justin Sharratt and Stephen Tatum were accused of unpremeditated murder[21]. Tatum was further charged with negligent homicide and assault, while de la Cruz was also charged with making a false statement. Squad leader Frank Wuterich was charged with 12 counts of unpremeditated murder against individuals and one count of the murder of six people “while engaged in an act inherently dangerous to others”[22]. The battalion commander, Jeffrey Chessani, was charged with one count of violating a lawful order and two counts of dereliction of duty. First Lieutenant Andrew Grayson was charged with obstruction of justice, dereliction of duty, and making a false statement, while Captain Randy Stone and Captain Lucas McConnell were charged with dereliction of duty. Stone also faces an additional count of violating a lawful order [21].

    [edit] Immunity

    On April 17, 2007, the Marine Corps dropped all charges against Sgt. Sanick P. Dela Cruz in exchange for immunity during testimony. Seven other Marines involved in the incident have also been granted immunity.

    Clearly,t hat’s from Wikipedia and shows that in Sharrat was not guilty of a legal crime when he gunned down those three brothers, because shooting unarmed civilians is okay as long as it’s within the ROE’s. The rest, especially Wuterich, will get their justice.

    As a soldier I know once told me (with relevance to Sharrat): “better to be tried by 12 than carried by six.”

    I’m glad the system worked here and BJTxs, Sharrat is in Murtha’s district and hasn’t received that apology yet either.

    Truth be told, edavis, Murtha owes every one of the accused an apology for shooting his mouth off about what Marines may have done before any charges had been filed. Innocent until proven guilty doesn’t apply to soldiers in a world where Murtha could get off a good soundbite.

    Update: Capt. Randy Stone has also been dismissed from the case.

    Time magazine, which breathlessly broke the story and hyped it as a “symbol of a war gone bad,” didn’t report the first dismissal and there’s nothing on their website about the two new dismissals.

    In dismissing the charges against Sharratt and Stone after what he said was an exhaustive review, Lt. Gen. James Mattis cited the difficult battle conditions and a “shadowy enemy” whose forces hid among civilians.

    “With the dismissal of these charges Lance Cpl. Sharratt may conclude that he did his best to live up to the standards, followed by U.S. fighting men throughout our many wars, in the face of life or death decisions made in a matter of seconds in combat,” Mattis said.

    “As he has always remained cloaked in the presumption of innocence, with this dismissal of charges, he remains in the eyes of the law — and in my eyes, innocent.”

    Mattis said that while Stone may have made mistakes, they did not “rise to the level of criminal behavior.”

    I have to admit that I am happy that they came to this resolution. I think that Murtha and the media should be forced to issue an the number of apologies equivalent to the number of times they made baseless charges against these Marines.

    TW : goat reference. If Murtha would quit sucking up to the goat fuckers, I would not have to reference his lunacy any longer.

    For those that agree that John Murtha owes this Marine and the others a huge apology for making statements about their guilt without a benefit of a trial and having now found out that all charges have been dropped, below I am listing the ways for you…..

    Well damn. First everyone’s new favorite winter soldier is debunked, and now this. Not to impune the motives of anyone in particular, but I’ve a feeling there are some who would really like to get beyond supporting the troops and back to spittin’ on ’em. Because of the OUTRAGE!! Because they’re worse than Jenjhis KHAAAANNNNN!!! Oh the frustration..
