The lawsuit here is a “tell us why you denied the FOIA request” one, which you get standing for automatically if your FOIA request is rejected (or ignored).
The real question is why the ACLU thinks this is a matter for a civil liberties union.
(The answer, of course, is that they’re not really a generic “civil liberties” organization, but a progressive activist group (for proof, look at their complete denial that anyone has a right to armed self defense, and (last time I checked, pre-Heller) that somehow the Second Amendment is the only one that, despite being all about “the people” somehow doesn’t confer any protection to a right of individuals).
