Widespread Corruption Charges Shock Illinois [Dan Collins]

Is the headline to Daniel Politi’s round-up of newspaper coverage of Blagogate.  All I have to say is that Illini are pretty damn ‘incurious,’ considering “that Blagojevich is the fifth Illinois governor to be charged with criminal conduct over the last 50 years.”

Mind you, this is the site that gave ought-to-be disgraced Ex-Prosecutor-Turned-Governor Eliot Spitzer a column.  It’s going to be interesting to see what Spitzer has to say on this subject, if anything.

From the end of this piece, we hear again from our old pal, licensed journalist Tim Egan:

In an op-ed piece, the NYT‘s Timothy Egan says that the complaint against Blagojevich “showed a man trolling the depths of darkness,” where nothing was sacred and anything could be used for political and personal gain. “It would be somewhat comforting if there were a larger lesson here, or a map out of the banality of evil,” writes Egan. “But there is no trend or modern twist, no evidence of a greater criminal web, no overarching moral. Like a kid who beats up old ladies just because he knows no other way, the allegations against Blagojevich amount to what Fitzgerald called a crime spree, of the political variety.”

So squalid is this corruption, according to Egan, that it must be sui generis.  No lessons here.  No moral.  No contamination.  Move along.

In comments to a previous post, geoffb notes the Volokh post by Jim Lindgren in which the following appears:

On Tuesday, Dec. 8, Obama denies personal knowledge of the corrupt proposal.

“I had no contact with the governor or his office and so we were not, I was not aware of what was happening.”

As I’ve said before, as with Bill Clinton, Barack Obama’s words should be read carefully to see what he is saying and not saying. Apparently, Obama started to say that “we were not” “aware of what was happening,” but corrected himself by saying that “I was not aware of what was happening.”

That language leaves open the possibility that his staff was aware, but he personally was not. But why would Obama’s staff withhold information from him? I assume that Obama is telling the truth about not having spoken to the governor himself, since that might be easily refuted.

CONCLUSION:

From the evening of Nov. 10 until yesterday, Blagojevich, Obama, and his transition team acted in ways that are consistent with a knowledge of Blagojevich’s bribery attempt and a rejection of that attempt. What doesn’t fit easily with the timeline is Obama’s statement yesterday.

It should be noted that it is not a crime to fail to report a bribery attempt. The federal misprision of felony statute would seem to make it a federal crime to fail to report a federal felony:

Whoever, having knowledge of the actual commission of a felony cognizable by a court of the United States, conceals and does not as soon as possible make known the same to some judge or other person in civil or military authority under the United States, shall be fined under this title or imprisoned not more than three years, or both. 18 USC s.4.

But case law has conclusively determined that mere non-reporting is not enough. Active concealment or the acceptance of a benefit for concealing is required.

Yet, looking at this timeline of Blagogate, it seems quite possible that someone in the Obama Camp is either lying or at least not revealing what they know. I also find it hard to believe that Obama’s closest advisors were hiding major corruption from him, especially as he was making decisions about where to place Senate candidates such as Jarrett.

Something important is missing from this story. Let’s hope that, whatever it is, the absent fact or explanation will allow the narrative to fit Obama’s denial more naturally.

Since by all accounts, the Obama camp refused Blagojevich’s bribery attempt, it would be extremely unwise to lie about it. Remember, it’s not the crime that trips you up; it’s the cover-up.

    One might think that nobody at this site had ever criticized a Republican for his bad actions, nor criticized the Republican Party for bad policy decisions. At least, one might think that if one believed the incessant bleatings of this site’s resident “political independent.”

    In Egan’s defense, I shared a similar reaction when digesting yesterday’s events. Blago’s actions were stunning not only for their stupidity, blatancy, and criminality, but also for their banality. There was no evil mastermind hatching some nefarious plot; there was just a political boss engaging in bribery and extortion.

    To be sure, the accusations are huge. But they’re not complicated. It’s just pay-to-play blown up to a really big size.

    If the guy can get caught going to a racist church for 20 years, say I can no more disown Rev. That was the best Christmas ever so far.     Obama insisted that none of his staff had a part in the attempted selling of his Senate seat by Gov. Blagojevich. “I have never spoken with the governor on this subject. I am confident that no representative of mine would have any part in any deals related to this seat,” Obama said. It appears that Obama’s chief of staff, Rahm Emanuel, has been talking to Blagojevich. The details of those discussions are not yet known.
