“Attorneys for John Walker Lindh, the American who fought with the Taliban, asked a federal court Tuesday to release him pending trial on charges that he conspired to kill U.S. forces in Afghanistan.
“Lindh’s lawyers, in written papers filed here, said there is no evidence ‘that Mr. Lindh is a flight risk,'” The Washington Post reports.
The filing also contended that the government’s charges, based on an FBI affidavit, are so weak that they are ‘insufficient to establish probable cause for the crimes charged.’
As understood by bin Walker’s lawyers, not being a “flight risk” must mean something along the lines of, “it is highly unlikely that Johnny will sprout wings and take to gliding over large bodies of water, looking to prey upon fish with his newly-discovered beak and razor-sharp talons.”
Similarly, “probable cause,” to this same Taliboy DreamTeam, must mean something like “guilt beyond a reasonable doubt” — as in, “the government’s charges, based on an FBI affidavit, are so weak that they are insufficent to establish guilt beyond a reasonable doubt for the crimes charged.'”
‘Cause simply finding Walker on the enemy side of the battlefield in Afghanistan is enough, I’d think, to establish “probable cause”…
