No one is denying that Obama has the right to nominate whoever he chooses. But those who are insisting on the bloody obvious are ignoring that equal right that the Senate has to deny its Constitutionally-mandated consent, for any reason at all, and for however long suits it to do so.
Obama just needs to learn the Constitutional lesson that Congress saying “No” is not the same as Congress refusing to act. They DID act, when they chose to say “we’re not going to approve anyone until there is a new President”, and that is entirely within their Constitutional authority. Like the fella said, “If you choose not to decide, you still have made a choice”.
If Obama refused to offer any names (using his previous statements as precedent), no one would be complaining that he isn’t doing his job. And don’t criticize the Senate for using exactly the procedures and rules set forth by the Democrats in Congresses past…

You do realize that even if one was allowed it expires at the end of the next Senate session.
