Eric at Classical Values examines the very disturbing behavior on the part of the Obama Administration’s “can’t we all get along” push in the United Nations with the consequences of elevating so-called International Law over the American Constitution.
While it’s bad enough that most countries are sorely lacking in the free speech rights we take for granted as our birthright, there is a well-established clique of professors and activists in this country who don’t believe in free speech, and this will play right into their hands.
Eric links Anne Bayefsky , Frank Gaffney and Eugene Volokh all sounding the alarm on the gathering assault on free speech. Gaffney:
What is news, and deeply troubling at that, is the fact that President Obama and his administration are now formalizing this ominous alignment in international forums like the Human Rights Council. According to the past writings of Harold Koh, the former Yale Law School dean who is now the U.S. government’s top authority on international law and its application domestically, “norms” like the new Human Rights Council resolution should supercede U.S. laws and even the Constitution.The Ethics and Public Policy Center’s extraordinary Ed Whalen cites a 2004 essay by Koh, entitled “International Law as Part of Our Law,” as approvingly setting forth the transnationalist view that “Domestic courts must play a key role in coordinating U.S. domestic constitutional rules with rules of foreign and international law, not simply to promote American aims, but to advance the broader development of a well-functioning international judicial system.” Toward this end, Koh believes that, in several circumstances, it is “appropriate for the Supreme Court to construe our Constitution in light of foreign and international law.”
The conclusion seems inescapable: In yet another expression of the President’s arrogance, he and his administration are in the process of willfully promoting an agenda at odds with not just the Constitution but the larger national interest.
Stanford is not the first university – ostensibly institutions dedicated to free speech and inquiry – to quash speech it doesn’t agree with. And the statists on the Left have never been comfortable with individual political freedoms.

As a fellow small-L libertarian, I find the line between a sound theory’s self-evidence and the need to eventually consider what Ace’s byline says to be a thin one, granted. But I’m guessing the side doesn’t benefit much from betraying said principles by, among other things, setting up allies.

This is only the beginning of the transnational Kabuki dance. Not only will there be fur fights to come owing to Mr.Koh’s desire that international law supercede ours which is an inconstitutional interpretation at best; I’m not an idiot and realize that occasionally the SCOTUS examines international stautes when pondering a ruling-another sketchy practice in my book.
But wait until the Kyoto II treaty is seetled on in Copenhagen later this year. Not only will Obama sign it, but we will then recieve a sanctimonious scolding by the sycophantic legacy media, the academic intelligentsia, the Hollywood glitterati, and the liberal Democrats in congress That it Must! be Ratified!; not only in the name of gaia, but also to underscore Obama’s, “L’etat c’est moi” imperium…
To do anything less would be RAAAAAAAACIST!; but that Copenhagen is a hopelessly racist city filled with knuckle-dragging wingnutz was verified last week by the IOC’s rejection of “That Obama Show”…
But, should it not be ratified, proponents will simply use Mr.Koh’s perspective and adjust the laws accordingly to conform to “international” precedent; and trust that no one can afford to fully litigate such a proposition, or that thay could be effectively smeared as “borthers” or “ghosters” if they did so anyway…
It’s a sad day when the USA comes out against one of the tenets of it’s own constitution. I’m sure that Madison and Mason are cursing Obama and his ilk from the hearafter. Me? I am too, but on this plane of existence for some time to come, I hope…

I think the transnationalist speak-no-evil crowd is going to be greatly surprised at the number of Americans who really don’t give a shit about their feelings and their so-called rules, and continue to speak their minds opening and forcefully.

This would mean to me that either the America of its original Constitutional “rules” must disappear, as its Constitution would be “shredded”, or else that America should take over the World and “impose” its Constitution upon it. If only to aid/follow the natural course of a necessarily forward moving Evolutionary process, which produced our enlightened “rules” in the first place, I’m backing the latter option. Anyone truely believing in Evolution knows that the World is always “ready” for it. Anyone else is simply a run-of-the-mill member of an animal herd.

This Barrett Brown I know nothing of, but he seems to be the sort of horse’s ass that from time-to-time rides out against PW and all things goldstein and makes a horse’s ass when he realizes that no one is following his baseless and unsustainable charges. That Frisch bacillus was only the most extreme example of it. The takeaway is that they all fail, because to typecast PW is a fool’s errand. Am I wrong?
Charles Johnson: I was formerly friendly with him and gave his LGF some major shots in the arm when I was on the Dan Rather-gate story. I went on TV and talked him up; had my paper profile him. I quoted him a few times and we stayed loosely in touch. He seems to really have gone crazy. He has a hard-on for Christians in the public sphere that is bordering on rank bigotry. Which is weird on two levels. the first is that the overwhelming majority of Christians I know more or less accept evolution as broadly understood, and as sinners, understand human weakness and frailty better than most. In short, they are the most tolerant people I know.
They ain’t saints and plenty of them have some dumb opinions, but let me say this about that. I know more allegedly open-minded liberals in the MSM than most and I have to say that a newsroom is about 10x more close-minded and anti-logical thought process than the hardest line church I’ve been too.
I have no idea what CJ is on about these days but he is really….touched.
RS McCain: I have to say the dude has made some unseemly associations and/or hung around some websites I am not remotely cool about. This matters nothing, but I have to say that at the absolute best, he appears to have very careless about where and why he posted. His politics are his own, but I think we are better than some of the places he has posted. Probably a stout fellow, just doesnt think it through. At Least, I hope.

RS McCain: I have to say the dude has made some unseemly associations and/or hung around some websites I am not remotely cool about. This matters nothing, but I have to say that at the absolute best, he appears to have very careless about where and why he posted. His politics are his own, but I think we are better than some of the places he has posted. Probably a stout fellow, just doesnt think it through. At Least, I hope.
I do not believe RSM is a racist and it is way over the top for Charles Johnson and his little jerkoffs to keep attacking Stacy. One of them called me a racist for defending him. And they only started going after RSM when RSM defended Pam Geller. It is a bullshit attack.
I am not into Pam Geller’s site, but I also do not think she is a racist (they even call her a Nazi some times). I think Robert Spencer is over the top in his attacks of Islam, but the man has reasearched Islamo-extremism and a lot of it is absolutely true.
Fred Phellps does represents Christianity, but that fucknut only holds up signs at events he should stay away from and begs for a good asswhoopin. His followers, mostly relatives he might be having sex with (I don’t know that for sure–so I do not want to cross that LGF line), number in the dozens.
The threat to civilized society, right now, is not Texas Creationists or anti vacciners, but stems mostly from Islamic extremists, who even though they are a small minority of Muslims, number in the millions. And they support violence.

The thing that ticks me off about my comment #71, the speech code being struck down at MSU, is (a) the university is a state entity; (b) it has attorneys; (c) it has a law school – and it went ahead with a prior restraint on speech. And the university had to know full well that what it was doing was unConstitutional and it still tried to defend this dog’s breakfast of a case. It wasted money in a state that was broke to defend what was clearly wrong, all a sacrifice for political correctness.
I am not attacking the attorneys that went forth and did their jobs, to defend, but I am attacking the idiots that set this thing up to begin with! They bought off the professional protestors and the grievance-searchers, and now the state has to pay for this stupidity – a state that does not have the cash to pay the judgment, nor to pay for an appeal.
Is there any funds, I wonder, to have an addition to orientaion that says ‘Some people may call you very insulting names, including racial epithets, and you should either ignore those or tell them to sod off.’?

Dunno if Patterico is as far-gone dickish all the time as he was when he trumped up that imaginary charge (hey, I’m losing an argument big time here; aren’t you ‘threatening’ somebody?), but given that his day-job profession requires much more restraint and requires better evidence than he concocted that night, he should’ve known better. Maybe he needs a judge looking over his shoulder all the time to give that missing element of restraint; because there wasn’t much excuse for his overreaction. And he hasn’t come over here and apologized as far as I know, so that one cloud of ‘dickishnish’ is still hovering over his head and permeates his site. AFAIC.
