Henry Gates on Sgt Crowley: ‘He falsified his report’ [Darleen Click]

In a followup to the post below, the July 24, 4 pm hour John and Ken podcast is up. I’ve transcribed the 2 minute clip of Henry Gates on Gayle King’s show that is played just after the 4:30 pm news portion

Gates: … I don’t talk about people’s mothers…

King: umm-mmm

Gates: I, heh, have my own form of swearing …

King: Yes

Gates: … but you could get killed talking about somebody’s mother … [chuckling]

King: Yes

Gates: … in the barber shop let, let alone with a white police officer …

King: So, uh, it says that you have demanded an apology from him …

Gates: As a human being.

King: What are you asking for, specifically from him?

Gates: I would love to meet with Sgt Crowley …

King: Really?

Gates: I would love for him to look me in the eye and say ‘Professor Gates, I am sorry. I am sorry for the way I treated you. I am sorry for the fabrications I..I had to put in that report. And if he’s sincere, I would forgive him as a human being.

King: uh-hmm

Gates: This however has nothing to do whether or not I decide to move forward with the lawsuit, because as I said at the beginning …

King: You’re going to move or …?

Gates: I don’t know, I’m meeting with my lawyers, I want time off to think about it, it’s been a very emotional week.

King: I’m sure.

Gates: But, uh, I want to use what happened to me…uh…to bring the public’s attention to racial profiling.

King: I think it could be a teachable moment for all of us, black or white.

Gates: Gayle, I want to make a documentary for PBS or HBO or some place on racial profiling … on this kind of arbitrary and unacceptable behavior on behalf of the police force.

King: He has said that he is not going to apologize to you, that he has nothing to apologize for. What do you think about that?

Gates: Ah, well I think that he is probably trying to protect himself. I think he feels very vulnerable. Uh, I think he knows that (a) what he did was wrong and (b) that, um, he falsified his report.

I’m thinking Sgt. Crowley needs to be talking with some lawyers.

    Attorney Stuart London, who has defended countless cops in high-profile cases, including one of the NYPD officers charged in the 1998 beating and plunger torture of Abner Louima in 1998, said, “If (the officer is dealing) with someone who is not being cooperative and is unruly, (the tape) gives you more insight into the state of mind of the officer. That’s the most important part.”

    Nice pull by Richard Weir, Laurel J. Sweet and Benjamin Bell getting the Louima reference in there, with plunger torture no less.

    Gates:

    at what point can the cops legitimately arrest you for being an asshole.

    Do you know the protocol Joe? I don’t, but from what I gathered from listening and reading actual police officers, there is discretion. Example: One black police officer interviewed said that he would have arrested Gates after the first warning. Crowley gave him at least two warnings.

    From what I can also gather, police need to secure an area when running a burglary call. There were to B/E suspects reported by the witness. What if Gates’ wife was chained up in the basement. Or a child. What if William Jefferson was hiding in Gates freezer. What if, what if, what if.

    Joe, you continually speculate as to whether Gates should have been arrested after you’ve seen the police report. How much would you know to speculate, if you were the cop on the run? Would you know enough in the heat of the moment that you would need to account for everyone in the house? Would you follow Gates into the next room when he turns and leaves without permission to get his ID? A lot of decisions need to be made when you’re protecting a homeowner, you have little info and a belligerent black guy calling racism.

    Gates and Obama need to be hung out for this and I concur that Crowley should not weaken his defamation suit against Gates by going to the last supper with Black Jesus.

    alpuccino, pull the stick out of your ass. I agree it is becoming clearer and clearer that Gates probably should have been arrested for crossing that invisible asshole line in dealing with the police. But that was not clear right away. Nevertheless, neither of us were there. It was quickly apparent that this matter was not about race but about how far you can go in insulting a cop before he can arrest you. Liberty means having the right to be an asshole (to a point). That was the point I was making and it was a legitmate one. And of course the cops had to investigate the incident–Gates was arrested after they determined he was the rightful owner. He was arrested for disorderly conduct (aka being an asshole). And while the Cambridge cops appear to have been justified, if you think cops never ever get like this, well then you are an idiot. Gates is an asshole and an idiot (and I am not defending that content at all), but the question is how far can you push that in your own home and on your own property.

    And Obama jumped into this mess with both feet. What a foolish foolish move on his part. And you are correct, Obama made this about race, when it really never was about race. And I hope Obama gets politically hurt by it and that it (indirectly) helps derail real disasters coming at us like socialized medicine.

    And Gates may have bigger problems to face. Wouldn’t that be karmic justice.

    In the Gates fiasco, he could win fame and fortune because lots of people have lots of reasons to hate lots of cops. Like Rush says though, if you put a pile of dogshit in front of a liberal, he will step in it. Guarantee you that.     Crowley should go to the White House, be respectful, listen carefully and then with all the press there, with Obama and Gates standing next to him, explain that he did the right thing and he would do it again under similar circumstances.

    That will extend this story another two weeks. This story would have been over last week but for Obama jumping in on it. The more this story circulates the worse it gets for Obama. It has totally overwhelmed the health care debate.

    There’s a big difference from excusing behavior and understanding it.

    But people rightfully expect better of police officers, and despite whatever provocation the girl may have committed, in reacting as he did Deputy Schene brought discredit to himself, his fellow deputies, and police officers everywhere. Now he needs to face the consequences.

    Can anyone say “Certified Malicious Liar Al Sharpton” and “Tawanna Brawley”? Sharpton accused white cops of raping a black girl and accused the local D.A. of a coverup. The case was a hoax, used by the racist Sharpton to stir up hatred and anger to benefit his career. I think this may be more of the same, and I hope we gain the truth. Exposing an expert in racial profiling as a fraud would be another nail in the coffin of that unproven theory.

    In New Jersey, the State Police were accused of profiling, stopping more blacks than whites. The department undertook some education of their officers, if I remember correctly. Then, analysis of cameras on the turnpike where the alleged discrimination took place revealed that for whatever reason, black drivers engaged in speeding significantly more often than whites. That’s why they were stopped more often: it was not profiling!

    In Cincinnati, the University of Cincinnati did a study, which involved counting black and white drivers moving through a number of neighborhoods at different times of day and compared racial composition of drivers and police officers for traffic stops both during the day and at twilight, when race is difficult to recognize because of dwindling light. There was no evidence of broad racial profiling, with a few (perhaps 5 or 6 in a force of 1100) “outliers” stopping more than their police district and shift peers.

    Racial profiling may exist on an individual basis, but it is not prevalent, not ubiquitous, and the theory depends upon the prejudices of racial professionals for its continuing existence.

    I’ve had to pull out my ID to prove that I am, in fact, a faculty member on numerous occasions. When I was in the building late at night. When I was setting up for a review session in a lecture hall on Saturday or Sunday.

    Once even when I accidentally set off the alarm in the A/V cabinet while setting up (they changed the alarm code and I either missed the notice or my copy got lost in campus mail) — that time multiple university cops responded to the scene.

    I’m sure it was just because I’m black, though. Oh, wait: I’m not.

    Let’s acknowledge up front that Gates endured a bizarre and humiliating experience. Being escorted out of your home in handcuffs for what you perceive as no offense at all would feel like a grotesque invasion of privacy, due process, and property rights. Gates’s anger is therefore understandable. But just because an incident is — from one’s subjective perspective — unjustified does not make it racial. Gates was almost certainly not arrested because he was black, but quite possibly because he committed “contempt of cop,” an extralegal offense that can greatly affect the outcome of officer-civilian interactions.

    Sgt. Crowley had a difficult situation to address when he arrived and there was someone inside the house. If the person is the “owner” i.e. legal resident, then Crowley legally(constitutionally) may NOT ENTER the house without permission. However the sargent must find out if that person is the resident, and if he’s not being held hostage.
    My understanding is that Gates denied him entrance, but left the broken door to get the requested ID. Gates got the ID in the kitchen and turned around to find Crowley (suspiciously/illegally?) right behind him. Here’s where the 2 viewpoints come apart Gates feels intruded upon in his own home. Crowley must still ID the person, but as soon as he does, then he must leave. Gates doesn’t even know who this guy is. The communication really broke down at this point. Clearly Prof. Gates PhD did not feel treated as he felt he should, and he didn’t even get the officer’s name and badge#. From the police report, Sgt.Crowley did not get treated with respect either, and in front of 4-5 other officers too. So when Gates made the mistake of going out onto his porch (legally he was now outside of his home) he was arrested and handcuffed, behind his back.
    I feel that Crowley is right, race was not an issue. I feel that Gates and the President are right, that the arrest was a stupid action. I don’t see how it improved the situation. All I see is that in front of the crowd on the street, the cops demonstrated that they must be treated with respect or you get arrested, physically restrained, and taken away, and put into a jail cell. Some where here this begins to look like Iran, not USA.
    At least when the police in Wellesley, mistakenly cuffed a young pro athlete, and put him on the ground for being outside a bank that had been recently robbed by a black young man, the Wellesley police fixed the problem AT THE SCENE, and apologized both then and publicly. Gates didn’t get out of jail for 4 hours. How would you like to arrive home from China after traveling for ~20+ hours as Gates did, your body thinks that it is now 2-3 AM, and a well trained police sargent can’t handle a little guff?
    That’s how I see it.
    Let me know if Sgt. Crowley was in uniform or plain clothes and how that might change the interaction?

    1. We find it interesting that the fact that this was the professor’s home was evidently not clearly established long before the dispute escalated and transitioned into other issues;

    2. We find it fascinating that the versions of two members of society, who most would ordinarily view as responsible and honest citizens (this obviously does not include politicians), would vary so dramatically from a factual point of view.

    3. Finally, considering that the reading and viewing public were not present at the scene (and thus have no first hand knowledge), and that there is no video tape to our knowledge of the sequence of events and what was said, how so many have formed conclusions, and made assumptions, about who did what and who was wrong.

    There are some things which Professor Gates might have considered upon the arrival of the police, no matter how incensed he may have been.

    According to the Somerville Times in 2007, as a Harvard Law School student, Obama got 17 parking tickets during 1989-1991 from the Cambridge Police Department that he left unpaid until just weeks before he announced his bid for the presidency.

    “In other words, as a practicing lawyer in Chicago, he allowed these tickets and penalties to remain unpaid; as an Illinois state senator he allowed these tickets and fines to remain unpaid; and as a United States senator he allowed these almost-two-decade-old signs of his disdain for the law to remain unpaid,” commented John LeBoutillier on Newsmax.com.

    The Washington Post said two years ago that the tickets included parking without a proper permit and parking in a bus stop.

    The Associated Press reported in 2007 that Obama’s “healthy stack” of parking tickets was finally paid, including late fees, “two weeks before he officially launched his presidential campaign.”

    Said Jen Psaki, spokeswoman for Obama’s campaign during his race to the White House, “He didn’t owe that much and what he did owe, he paid. … Many people have parking tickets and late fees.”

    The White House press office did not respond to a request for a comment.

    Royf & BMoe – Agreed that Kyle is a great driver. Sensational. But I dislike him so much that I am usually torn between wanting to see him smashed into a wall and seeing Junior win. Neither happens nearly often enough for me. IRP is one of my favorite races every year. Ranks up there with Talladega and the Bristol night race for me. I like it way more than the Brickyard, though it is pretty cool to see NASCAR on the Speedway. Back to the track … Look for me. I will be in Turn 1. I will be the one cheering for Junior.     Mayor Daley’s comment serves to remind us that Obama had not held even so much as a dogcatcher post in an executive capacity before becoming President of the United States. Had he been a mayor or governor he would have know instantly not to get involved in a police matter without first ascertaining all the facts and would likely have been extremely reluctant to sound off even then. Obama’s ignorance and inexperience are going to get a lot of people killed unnecessarily before he’s done.

    Racial profiling is almost exclusively a drug war tactic, where it’s used to identify drug dealers and couriers. And it works, too.

    The thing is, this isn’t uncommon behavior for cops. They just have so much power, it tends to corrupt. I keep reading 90% of cops don’t do this kind of thing. I must say, that’s not my experience. I think far fewer cops act decently towards citizens most of the time. Although, my experiences with bad policing were in Houston in the 1980’s when cops were handcuffing people and drowning them in Buffalo Bayou.

    I don’t know what to do about it. It seems they need that power. Maybe we need more effective “Internal Affairs” departments. Although, I really hate that name, it suggests that the affairs of the Executive Branch of government are somehow “internal” instead of public acts of government. So, maybe we need truly independent police to monitor the police. I dunno.

    I do know that while many are outraged at the police actions here, few are likely surprised by it. That’s sad. –

    Actually, the 911 tapes came out today and in them it is proved that at no point does the woman identify the suspects as black, when specifically asked she stated I think one is hispanic, but didn’t see the other guy. Also, she specifically said several times on the tape that she was unsure if the people lived there and just had problems with the door, or if they were breaking in. Basic facts: Recordings don’t lie, but cops do.

    This issue isn’t a racial problem although I’m sure Professor Gates felt it was. I’m a middle aged white male and I can “guarantee you” the same thing would happen to me.

    Unfortunately Officer Crowley isn’t “smart enough” to walk away from Professor Gates home once his residency was established. END OF STORY, PERIOD (unless of course he was threatened).

    Cops “always harass”, & throw their weight around everytime they can! This happens to be everyday moron cop behavior. This isn’t a racial issue this is “typical rogue” cop “out of control” like ALWAYS!!!!

    They only way this is going to STOP is IF Professor Gates SUES this cop and my sincere hope is that he does!
