Those firefighters in the Ricci case sure recieved alot of empathy from her. Didn’t she pretty much just say “I empathize that you will not recieve your promotions now but I have more empathy toward the races other than yours so your screwed. Horked from Powerline this morning. In answer to Lahey’s opening remarks regarding Sotomayer’s “wise latina” thing, she said:
“What — the words that I use, I used agreeing with the sentiment that Justice Sandra Day O’Connor was attempting to convey. I understood that sentiment to be what I just spoke about, which is that both men and women were equally capable of being wise and fair judges.”
What she actually said in the speech in which she made the point about her own gender/race-based superiority:
“Whether born from experience or inherent physiological or cultural differences, a possibility I abhor less or discount less than my colleague Judge Cedarbaum, our gender and national origins may and will make a difference in our judging. Justice O’Connor has often been cited as saying that a wise old man and wise old woman will reach the same conclusion in deciding cases. I am not so sure Justice O’Connor is the author of that line since Professor Resnik attributes that line to Supreme Court Justice Coyle. I am also not so sure that I agree with the statement. First, as Professor Martha Minnow has noted, there can never be a universal definition of wise. Second, I would hope that a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male who hasn’t lived that life.”

Orrin Hatch asked Sotomayor whether the 2nd amendment wasn’t a fundamental right. S. replied with the odd formulation of fundamental — odd at least to non-lawyer’s ears — that the question of the 2nd amnd’t as fundamental hinged on an explicit incorporation of the 2nd amdn’t under the 14th amdn’t by the Supreme Court over against the States. That’s a nice metaphor of a broken politics, it seems. We mustn’t think beyond the rules of the court now, must we?

In early 2005 I attended a pro-troop rally in Washington DC, Sen Jeff Sessions showed up to show support; in my book he is a worthy human being.
Not many Americans showed up though, disappointing as that was it was great for those who did attend.
Fast forward to 2009 where Americans are NOW showing up because it’s all about their own personal wallets which are now being effected.
For the last seven fucking years most Americans would not show up to defend out troops who made the ultimate sacrifice so good thing there are the HEH Tea Parties, FINALLY Insta-Americans got off their lazy, apathetic, shiny-happy asses for a change.

I don’t for a minute believe that Sotomayor is at all stupid in the ordinary sense of the term.
She is unwise though, most especially to the extent that she chooses to waffle — if not outright lie — about the intent of her speech to the La Raza legal audience (and others). It may be inconvenient, for the moment, to stand up for her former philosophical principles, but she will look cowardly and dishonest in the long run should she find it more comfortable to return to them sometime down the road. Or in the alternative, should she choose to abandon her former belief permanently now, she will have demonstrated the unwisdom of taking those principles up in the first instance.
Either way, she can’t recover an offered benefit of the doubt very easily.

Imagine that you’re involved in a lawsuit: plaintiff or defendant — doesn’t matter.
Now imagine that the judge is a white man or woman who has gone on record as saying that s/he is of necessity more empathetic to white people, being a white person him/herself.

Also consider the following:
If Sotomayor were running for office in the legislative or executive branches — senator, mayor, governor, whatever — and she told a crowd of assembled Latinos that she could better represent their interests because she’s also Latina, then that would be absolutely appropriate, because that’s what you want in an elected official: someone who gets what you’re about.
But in the judicial branch, it’s anathema.
I have not been satisfied with the answers she’s given. She knows exactly what she’s NOT supposed to say, she knows that the questions are formulated to extract that information, and she’s doing a clumsy tap-dance around the “bad answers” that also happen to be true.
Look, if you want to dedicate your life to radical causes, go right ahead. It’s still a free country. But don’t go hiding those radical views later on, ya coward. If your causes aren’t palatable to the general public, so be it.
But I guess it’s more important to subvert the system from within. Play the moderate to get into office, then let ‘er rip with the radical stuff.
We’ll all thank her later, I guess, the way we were supposed to thank our parents for making us wear those dumb, painful, ugly braces during our teen years.

Maybe I’ve missed some of the confirmation hearings, but I’ve yet to hear anyone asking Judge Sotomayor about the Constitution. The Second Amendment was briefly touched on, and her response was on the order of “I have a relative in the NRA and some friends who hunt”. I think much more could be gleaned from the good Judge in this area, and her view that the Bill of Rights does not protect states citizens’ right to keep and bear arms.

I just heard the good Judge deny that the 2nd Amendment is a fundamental individual right. If any of the members of the Judiciary Committee would care to explore this line of inquiry, I think the populace would be very grateful.

Of course, inquiring into clauses not cases would require senators to know something about the original meaning of the Constitution. It would interesting to hear what Sen. Al Franken thinks about such matters, but no more so than any other member of the Judiciary Committee. Such a hearing would not only be entertaining, it would be informative and educational. After all, it would be about the meaning of the Constitution, which is to say it would be about something.

I liked the part where she really couldn’t say whether Senator Coburn, as an American citizen, has a right to self defense. Too abstract a question, you see. Knowing that this stupid bint is about to take a seat on SCOTUS restores my faith in this great nation. Anything is possible, kids!

I have heard a great deal from the punditocracy on how damaging to Republicanos would be a public flaying of Sotomayor – apparently Hispanics are waiting with bated breath to see how (mis)treated Her Honor is. I can’t believe her gutting of the 2nd Amendment is going to do her any favours either with Hispanics or pro-gun Dems. This would have been a better club, in my view, than the “wise Latina” with which to beat her about the head.

I know this has nothing to do with the post… NE ways, Obama is a socialist. The only way socialism can ever succeed is if it kills poor, black and hispanic babies. That is why abortion needs to continue to be legal. So that the socialist government of Obama won’t have to support the poor with welfare and other government aid. Imagine this, if our taxes had to support millions upon millions of poor black and hispanic people – the government would go bankrupt… Everyone wants to live longer and people want to do this at all costs – even killing babies. Genocide of the poor and the weak – that’s the Obama story. He’s the Black Hero… Why do liberals and socialists talk about population control and yet want all these drugs and health care privilages for everyone to live longer? Talk about irony. If you liberals and socialists want to control population, then be the first to die! Why fund health care? Maybe it’s because of your selfishness and carelessness for your fellow man??? LOL! How ironic!
