On a more sobering note.

WASHINGTON — Supporters of Supreme Court nominee Sonia Sotomayor are quietly targeting the Connecticut firefighter who’s at the center of Sotomayor’s most controversial ruling.

On the eve of Sotomayor’s Senate confirmation hearing, her advocates have been urging journalists to scrutinize what one called the “troubled and litigious work history” of firefighter Frank Ricci. [...]

On Friday, citing in an e-mail “Frank Ricci’s troubled and litigious work history,” the liberal advocacy group People for the American Way [a George Soros funded leftist group ... ed.] drew reporters’ attention to Ricci’s past. Other advocates for Sotomayor have discreetly urged journalists to pursue similar story lines. [...]

No People for the American Way officials could be reached Friday to speak on the record about the press campaign. [...]

“Sotomayor and her panel colleagues were bound by long-standing precedent and federal law,” People for the American Way executive vice president Marge Baker said in a June statement. “They applied the law without regard to their personal views.”

Last month, however, the Supreme Court overturned the 2nd Circuit by 5-4.

“Once . . . employers have made clear their selection criteria, they may not then invalidate the test results, thus upsetting an employee’s legitimate expectation not to be judged on the basis of race,” Justice Anthony Kennedy wrote for the majority.

With his awards for bravery, some 17 years of fire department service and history of overcoming dyslexia, Ricci has become a compelling human character in the Sotomayor confirmation drama. Senate Republicans have summoned him, along with Lt. Ben Vargas of the New Haven Fire Department, as two of their 14 witnesses next week.

    It truly makes me want to go “postal” hearing that Soros through all of his various “activist” groups are overtly courting the media to go after Ricci, and try and paint him as litigious…

    This from the same crowd that files harrassing ethics complaints against the likes of Palin, and proudly mau-maus into submission any that will not comply with their totalitarian, statist, groupthink, C ideology, and vision for an America of equal outcome

    Sotomayor has the “misfortune” of actually leaving a paper trail; too bad she wasn’t from Chicago, where such things disappear “conveniently”. But that same trail points to some inconvient truths about her personal beliefs, her past associations, and some stubborn facts regarding her history. And it doesn’t help her that in the law business, you write opinions, so those words don’t float away in the breeze, nor are they as easily walked back, as quotations of spoken statements…

    No, as we used to say, “Her Battleship mouth has gotten her into a jam that her rowboat ass can’t back up”. And it doesn’t look like the MSM was going to come riding to the rescue like they did when Obama did the same vis-a-vis “Joe the Plumber”, an embarrasing moment for the press corps, the corrupt Ohio government officials who participated in Joe’s destruction, and our nation as a whole…

    And now it look like the Soros machine would like to see the same thing Happen to Frank Ricci. They better tread lightly if they take the bait, because the public won’t as easily buy that same act twice…

    This is a terrible strategy for supporters of Sonya Sotomayor because it will back fire on them. Firefighters are not easy to paint as bad guys.

    Personally, I hope Sotomayor gets confirmed. Not because I like her, far from it, her decisions are a mess and disaster–but she is better than the alternatives in the wings (the most likely being Diane Woods). Obama has a lock on the process and barring a complete meltdown he is going to get his nominee confirmed.

    The GOP needs to be careful not to make Sotomayor a Hispanic nominee getting grilled–the fact she is Puerto Rican is not an issue and in fact Sotomayor is far more self made than Obama is. While Sotomayor is not a cutting edge legal intellect, she grew up in project in the Bronx to parents who came from Puerto Rico, did get good grades in Catholic parochial schools, was encouraged by the nuns to go to Princeton where she did well, etc. Her legal opinions are flawed and wrong, but she is not a fool. The GOP needs to use these hearings to show what Sotomayor is all about (and show what Obama is all about and why he picked her).

    The Supreme Court of the US just determined that she violated precedent, most likely Bakke-though I haven’t read the decision, both by assenting to race being the only factor in personell decisions as well as the fear that the municipality would be mau-maued by community groups.

    She does have a good story, though I would hazard so do many of us here amongst the PW commentariat. Does a “good story” make each of us qualified as SCOTUS justices? Does a belief in minority exceptionalism, one that would disqualify her immediately if she were white, automatically qualify her for SCOTUS? The Democrats didn’t seem to fear any Hispanic backlash when they pulled their usual tactics on Gonzales and Estrada; did they suffer as a result if this? If Roberts belonged to any organization analogous to “La Raza” would he be sitting on the court right now? Boooooosh! had control of the process for 3/4 of his term, yet many of his appointments never even recieved a vote!

    Many of the preceeding questions were rhetorical, and I’m not getting down on you personally Joe. I just feel that the RethugliKKKanz shouldn’t fear any hispanic backlash, as they can’t expect to get that vote in the first place; a much greater test is to come anyway when Obama brings up an amnesty provision. The hearings should be be excruciatingly thorough, and no questionable element of her past left un-examined publicly, so that not only does the public realize what they’re getting in Sotomayor, but so that Obama’s ideological beliefs, and political calculus of race, be better exposed to public scrutiny, since he has proffered her as mainstream and middle of the road…

    I realize much more overtly partisan nominees are in the wings. But if Sotomayor essentially gets a free pass, how much easier will it be to portray them as “just a bit left” of her, when the next retirement comes…

    I agree with what you say Bob, and I am not suggesting she get a free pass. She should be grilled in a manner that is professional but very tough.

    But Senate votes are votes, and the Dems have plenty. The reality is the GOP will ultimately lose this fight (even if the GOP managed to derail Sotomayor, it would likely alienate Hispanics and Obama would nominate Diane Wood who is smarter, and even worse on policy). If I thought the back up alternatives were better than Sotomayor, then I would say go for it, but they are not, they are worse.

    The picture isn’t the smartest thing in the world, now is it? She’s Puerto Rican not Cuban, and the whole “Obama is a Communist” thing didn’t work out too well, now did it? Let me suggest looking into whether she has links to interesting folks and ideas in the same way that, for instance, LuisGutierrez does. That would be a public service, as long as it’s completely fact-based.

    Also, I don’t exactly see a plan to push back against those who’ll be pushing PFAW’s line; perhaps coming up with one might be a good idea.

    As for Obama’s underlying communism? The more the public becomes dissatisfied with him, his policies, and administration the whole communist thing will be able to be recycled; and this time it will have more traction, since he will have demonstrated what could only be alluded to and speculated in advance…

    A party moving (applying) for summary judgment is attempting to eliminate its risk of losing at trial, and possibly avoid having to go through discovery, by demonstrating to the judge, by sworn statements and documentary evidence, that there are no material issues of fact remaining to be tried. If there’s nothing for the jury to decide, then, the moving party asks rhetorically, why have a trial? The moving party will also attempt to persuade the court that the undisputed material facts require judgment to be entered in favor of the moving party. In many jurisdictions, a party moving for summary judgment takes the risk that, although the judge may agree there are no material issues of fact remaining for trial, the judge may also find that it is the non-moving party who is entitled to judgment as a matter of law.

    That is what the Ricci case is really about as far as the hearings and the Supreme Court ruling is concerned.

    The court was 5-4 in ruling on the facts of the Ricci case, but 9-0 against Sotomayor in her refusal to hear the case. This should be of concern to the confirmation committee, but it probably won’t be.

    The housing projects in which they grew up were different in another and more fundamental way.
